Subject: Customer taking legal action against us

Hi Dave

 

Just a brief email FYI incase anything comes of an inspection I carried out this morning.

 

Our customer Mrs C Frost S28278 said that she will be taking legal action against Mr Carpet as she is not happy with the carpet that we fitted to her Lounge earlier this week. She feels that is a different colour to the carpet that we fitted upstairs that is the same material, fitted at the same time. I informed her that the carpet (Ullswater) is a synthetic carpet that reflects light and given the she has a window at the front of her Lounge and double doors leading out onto a glass conservatory at the rear causing through lighting therefore causing the carpet to look slightly lighter. She does not have through lighting to the other areas. She then asked if Mr Carpet were prepared to change the carpet given the business that they had given us in the past to which I said no, as I could see how replacing the carpet would help the situation as it would have the same effect to which she replied I thought you’d say that. I told her that I would ask the manufacturers to take a look even though they had already confirmed that the 2x 4m cuts ordered were from the same roll and were cut at the same time 1 after the other. She said that the manufacturers would have to see it before the end of next week. I said that I would fill out a complaint form 1st thing on Monday morning and would ask the manufacturers to deal with it as a matter of urgency but could not guarantee it being inspected by them by the end of next week. At this point she said that she had spoken to a professional that said rolls can verify in colour from start to finish and that we would have a letter from her solicitor on Tuesday via a courier as in her words “Austin and I do not pay for what we do not like” (the was balance to card that we took on Weds 6th)  

 

I have asked that all further correspondence be via email so that we can all keep a paper trail.

 

I do not feel that the carpets are different colours and therefore find the fault/ issue unfounded. I had a sample of the carpet posted to her prior to todays inspection to offer against the carpet (see images attached) only to prove the carpet is the same.

 

Again this email is purely FYI. Should I receive a letter on Tuesday I will be in touch.
